Welcome to Pixie ("Service", "we", "us", or "our"). By accessing or using trypixie.com and our related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
2. Description of Service
Pixie is a record-keeping and organizational tool designed to help parents and business owners:
- Document legitimate work performed by their children
- Track wages paid and hours worked
- Monitor Roth IRA contribution eligibility and limits
- Generate reports and documentation for tax purposes
- Store photos and notes related to work performed
Pixie is an educational and record-keeping tool only. We do not provide legal, tax, accounting, or financial advice. You should consult with qualified professionals (CPAs, tax attorneys, financial advisors) before making any tax or financial decisions.
3. Eligibility and Account Registration
You must be at least 18 years old to create an account and use our Service. By creating an account, you represent and warrant that:
- You are at least 18 years of age
- All information you provide is accurate and complete
- You will maintain the accuracy of such information
- You are legally authorized to employ or compensate the children whose information you add to the Service
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
4. User Responsibilities and Prohibited Conduct
You agree to use the Service only for lawful purposes. You agree NOT to:
- Violate any federal, state, or local laws, including tax laws and child labor laws
- Upload false, misleading, or fraudulent information
- Use the Service to create fake documentation or falsify records
- Document payments for work that was not actually performed
- Violate the privacy rights of children or other individuals
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use the Service in any way that could harm minors
- Reverse engineer, decompile, or disassemble any portion of the Service
Important Compliance Note: You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including but not limited to:
- IRS regulations regarding employment of children and deduction of wages
- State and federal child labor laws
- Fair Labor Standards Act (FLSA) requirements
- Applicable payroll and withholding tax requirements
- Roth IRA contribution rules and limits
5. Subscription Plans and Payments
Pixie offers subscription-based plans with a 14-day free trial period. By subscribing to a paid plan, you agree to the following:
- Free Trial: New users receive a 14-day free trial. No credit card is required to start the trial. You can cancel at any time during the trial period without being charged.
- Billing: After the trial period ends, you will be automatically charged for your selected plan (monthly or annual) unless you cancel before the trial expires.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be provided for partial billing periods.
- Price Changes: We reserve the right to change our pricing. We will provide at least 30 days' notice of any price increases. Continued use of the Service after a price change constitutes acceptance of the new pricing.
- Payment Processing: Payments are processed through Stripe, a third-party payment processor. You agree to Stripe's terms of service and privacy policy.
6. Data and Content Ownership
Your Content: You retain all ownership rights to the content you upload to the Service, including job descriptions, photos, notes, and financial data ("Your Content"). By uploading Your Content, you grant Pixie a limited, non-exclusive, royalty-free license to store, display, and process Your Content solely for the purpose of providing the Service to you.
Our Platform: Pixie retains all rights, title, and interest in and to the Service, including all software, algorithms, features, and functionality. You may not copy, modify, distribute, sell, or lease any part of our Service.
Data Backup: While we maintain regular backups, you are responsible for maintaining your own backups of important data. We strongly recommend downloading exports of your data regularly.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
Children's Information: While you may enter information about children in your account, the Service is not directed to children under 13, and we do not knowingly collect personal information directly from children. Parents and guardians are responsible for the information they enter about their children.
8. Disclaimers and Limitations of Liability
NO TAX OR LEGAL ADVICE: PIXIE DOES NOT PROVIDE TAX, LEGAL, ACCOUNTING, OR FINANCIAL ADVICE. THE SERVICE IS PROVIDED FOR INFORMATIONAL AND RECORD-KEEPING PURPOSES ONLY. YOU SHOULD CONSULT WITH QUALIFIED PROFESSIONALS BEFORE MAKING ANY TAX OR FINANCIAL DECISIONS.
NO WARRANTIES: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or alteration of your data
- Any tax liability, penalties, or interest resulting from your use of the Service
- Any IRS audit or investigation
- Any errors or omissions in the Service or content
- Any interruption or cessation of the Service
IN NO EVENT SHALL PIXIE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO PIXIE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
IRS Compliance: Pixie provides tools to help you organize information, but we do not guarantee that your use of the Service will result in IRS compliance or approval. You are solely responsible for ensuring that your tax filings are accurate and compliant with all applicable tax laws.
9. Indemnification
You agree to indemnify, defend, and hold harmless Pixie, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, interest, and expenses (including attorneys' fees) that directly or indirectly arise from or are related to:
- Your use of the Service
- Your breach of these Terms
- Your violation of any law or regulation
- Your violation of any rights of another person or entity
- Any tax liability, penalties, or audits resulting from your use of the Service
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- You will have 30 days to download your data before it may be deleted
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability
You may terminate your account at any time by canceling your subscription and deleting your account from the Settings page.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.
You agree to waive any right to a jury trial and to participate in any class action lawsuits against Pixie.
12. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixie regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure: Pixie shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
